Terms and Conditions

Funtasia is open to the public. There are areas within Funtasia where specific charges apply. To access the paid for areas a ticket must be purchased. This can be purchased using our website www.Funtasia.ie, over the phone or by arriving at our venue.

Online tickets must be purchased only through the official Funtasia website, any other websites purporting to sell Funtasia tickets are unauthorised and the purchase of tickets from these sources may lead to entry being refused. Upon purchase of a ticket or gift voucher from our website you will receive an email, to the email address you have supplied, with your ticket or gift voucher. The email constitutes your proof of purchase. Please check that you have received this email following purchase. We take no responsibility should you not receive this email due to reasons outside of our control.

It is your responsibility to check the accuracy of the details on your ticket or gift voucher before confirming the purchase. Funtasia does not accept any responsibility for bookings that are incorrect due to an error on the part of the customer.

It is possible to book tickets in person at Funtasia. Tickets can be purchased at our desks. Please note that all of our areas and activities have capacity limits and we do not guarantee the availability of any given area or attraction where it has not been pre-booked.

All parties, corporate events and group bookings must be booked directly with the Funtasia Sales Team either through e-mail: info@Funtasia or by phone at 9898000 These Terms & Conditions (“Terms”) set out all the terms and conditions upon which we provide you and your guests (“you” and “your”) with access to Funtasia.

Terms and Conditions of Entry

Funtasia is located at Unit 1, Donore Rd, Drogheda, Co,Louth., ph. 98-98-000, e-mail: info@Funtasia.ie. All persons entering Funtasia (visitors) (both paying and non-paying) do so subject to their adherence to the Terms and Conditions as outlined below.

1. Tickets

TERMS & CONDITIONS OF USE ONLINE DISCOUNTED TICKETS ARE NOT FAST TRACK OR PRIORITY TICKETS. CUSTOMERS MUST QUEUE AS NORMAL.By using this ticket, the holder hereof agrees to and accepts all conditions of acceptance contained herein and all arena / organisation rules and standards of conduct posted in or about the venue.
• Ensure your ticket is from an authorised agent only. Those with counterfeit tickets will be refused admission and maybe prosecuted. • Tickets may not be resold for more than face value
• It is with regret that we cannot refund or exchange any tickets after purchase.•Event partners reserve the right to refuse admittance to the venue or to remove any person from the venue for reasons of public safety, any unacceptable behaviour likely to cause damage, nuisance or injury or for any breach of event partners terms & conditions.
•Holder consents to a reasonable examination of his/her person and belongings to ensure compliance with all rules and regulations. • Unless written permission is given by the organiser this ticket cannot be used for any promotional purposes.
• The event will take place ‘rain or shine’ unless otherwise indicated by event partners.
• Event partners reserve the right to make reasonable alterations or changes to the programme, staging or seating of the event without prior notification & without being obliged to refund monies or exchange tickets unless such alterations or changes make the event materially different to the event that the average consumer would have expected when purchasing a ticket.
•After purchase the holder of this ticket is responsible for its care. Ticket agents do not accept any responsibility for any loss or damage of the ticket.
•Ticket holder voluntarily assumes all risk and danger of personal injury and responsibility for property loss, destruction or theft and all hazards arising from or relating in any way to the event for which this ticket is issued whether occurring prior to, during or after the event and releases the ticket issuer, the event producer, the facility, the sponsors, and all organisations involved from all liability thereafter save where and to the extent that arises from breach of contract (not due to the Force Majeure) or by the negligent act or omission of said organisations involved. • There will be no refunds available on unused tickets.

2. Funtasia Entry

Some attractions require parental supervision for entry. Entry to individual activities can be booked online, or at each desk.

3. Conduct of Visitors

3.1 Funtasia reserves the right, in its absolute discretion, to refuse entry to, or remove from Funtasia or the vicinity without refund, any person who:-
3.1.1 Behaves in a manner which, in the opinion of Funtasia, its employees, contractors or agents, has affected or is likely to affect the safety or enjoyment of, or cause annoyance, danger or distress to, other visitors or damage to property;
3.1.2 Uses threatening, intimidating, abusive or insulting words or behaviour or in any way provokes or behaves in a manner which may provoke a breach of the peace;
3.1.3 Appears, in the opinion of an employee or agent of Funtasia, to be under the influence of alcohol or other substances; or 3.1.4 for any other reason at the sole discretion of Funtasia, its employees, contractors, agents or licensees.

3.2 A person to whom Terms 3.1.1, 3.1.2, 3.1.3 or 3.1.4 applies will be liable for any damage caused or expenses incurred by his or her behaviour. Funtasia reserves the right to prosecute in pursuit of recovering the cost of such damage.

3.3 Funtasia is a smoke-free facility and smoking (including of e-cigarettes) is prohibited at all times. Persons in breach of this rule will be asked to leave.

3.4 There are multiple food and beverage outlets on the premises and you are not permitted to consume your own food or beverage in these areas. Guests who do bring their own food to Funtasia may be asked to consume it in a designated area.
Pets or animals of any nature (with the exception of assistance dogs) are expressly prohibited in Funtasia.

3.6 It is prohibited to bring into Funtasia any of the following; Weapons, fireworks, smoke bombs, glass bottles, blades, flammable liquids, portable BBQs or other articles that may cause injury. Skateboards, rollerblades, roller skates, bikes, scooters and other forms of personal transport. Balls, hurleys, frisbees, balloons or other similar items. Pets or other animals of any nature.

3.7 You are not permitted to bring alcohol into Funtasia. Any persons found possessing alcohol on entry, or who appear to be unduly under the influence of alcohol may be refused admission or escorted out without right to refund.

5. Limitation of Liability

5.1 OTHER THAN LIABILITY FOR DEATH OR PERSONAL INJURY RESULTING FROM THE NEGLIGENCE OF Funtasia, ITS EMPLOYEES OR AGENTS, Funtasia SHALL NOT BE LIABLE TO VISITORS FOR ANY LOSS OR DAMAGE, DIRECT OR INDIRECT, HOWSOEVER ARISING. Funtasia SHALL NOT BE LIABLE FOR ANY ENTRANT'S PROPERTY LOST OR DAMAGED AT Funtasia AND SUCH PROPERTY IS AT THE SOLE RISK OF THE ENTRANT.

6. Events Outside the Control of Funtasia

6.1 Funtasia is not liable or responsible for any failure to perform, or delay in performance of, any of its obligations caused by events outside its reasonable control.
6.2 It must be understood that for operational, technical, weather related or other reasons beyond our control, any attraction or exhibit may have to be closed, removed, altered in type or otherwise be unavailable at any time due to inclement weather, technical issues or otherwise without prior notice.

7.Privacy

1) What personal information do we collect?
The GDPR applies to ‘personal data’ meaning any information relating to an identifiable person who can be directly or indirectly identified in particular by reference to an identifier. This definition provides for a wide range of personal identifiers to constitute personal data, including name, identification number, location data or online identifier, reflecting changes in technology and the way organisations collect information about people. The GDPR applies to both automated personal data and to manual filing systems where personal data are accessible according to specific criteria. This could include chronologically ordered sets of manual records containing personal data.

We only collect data which you have submitted via online website service or in-house sign ups. The only data stored is data by which the person(s) have selected to be subscribed to our mailing list for various promotions and information.

We therefore typically process the following types of personal information about you:
contact information (such as name, residential/mailing address, telephone / mobile number, email address);
date of birth
information about your health issues (if any); and
to communicate with you if any products or services you have requested are unavailable
When you make contact with us for other purposes, we may also collect personal information about you in relation to those purposes. For example, we may collect your personal information so we can contact you about a competition you have entered (e.g. if you win) or to respond to an enquiry or feedback you have sent to us.
2) How do we collect personal information?
We will only collect personal information in compliance with GDPR. We usually collect your personal information from the information you submit during the course of your relationship with us. We will collect this information directly from you unless it is unreasonable or impracticable to do so. If you do not agree to this policy, please do not use our websites. Your continued use of the websites following the posting of changes to this policy will be deemed your acceptance of those changes
Generally, this collection will occur:
when you deal with us either in person, by telephone, letter, email;
when you sign up to receive communications from us at a stand or in another public event we attend
when you visit any of our websites
We make every effort to maintain the accuracy and completeness of your personal information which we store and to ensure that all of your personal information is up to date. However, you can assist us with this considerably by promptly contacting us if there are any changes to your personal information or if you become aware that we have inaccurate personal information relating to you. We will not be responsible for any losses arising from any inaccurate, inauthentic, deficient or incomplete personal information that you, or a person acting on your behalf, provide to us.
3) How do we use your personal information?
We will only process your information, where: you have given your consent to such processing (which you may withdraw at any time);
the processing is necessary to provide our services to you;
the processing is necessary for compliance with our legal obligations; and/ or
The purposes for which we collect personal information further include:
identification of fraud or error;
regulatory reporting and compliance;
developing and improving our products

Where permitted by GDPR, we may use your personal information to send you targeted marketing activities relating to our products and services that we think may interest you, unless you have requested not to receive such information. These may include, but are not limited to, mail outs, electronic marketing and notifications as described below, and telephone calls). We will only use your personal information to send electronic marketing materials to you (including e-newsletters, email and SMS,) if you have opted-in to receive them.

Should you no longer wish to receive promotional/marketing material from us or receive other types of communication from us, please refer to the “Contact” section below. You can unsubscribe from receiving electronic marketing materials by following the unsubscribe prompt in your email and SMS. Please also see the “Your rights” section of this Notice to learn about your ability, at any time, to opt out or limit the use of your browsing behaviour for online behavioural advertising purposes.

4) Is personal information disclosed to third parties?
We do not and will not sell your personal information in any circumstance.
5) Retention of information
We will retain your personal data only for as long as is necessary for the purposes for which it was collected and in order to meet the legal and business requirements of managing your customer account and experience with us. In particular:
We will retain personal data that is necessary for us to provide you with a product or service that you have requested or purchased for as long as it takes us to provide that product or service;
We will retain your contact details for marketing purposes for as long as we have your permission to send you marketing information or for as long as we are permitted to do so, subject to your right to object at any stage; We will retain records of any transactions you enter into with us or products or services you receive for up to seven years. This is so that we can respond to any complaints or disputes that arise in that period; We will destroy or de-identify personal information once we no longer require it for our business purposes, you request it, or as required by our retention period or by law.

If you wish to:
update, modify, delete or obtain a copy of the personal information that we hold on you; or
restrict or stop us from using any of the personal information which we hold on you, including by withdrawing any consent you have previously given to the processing of such information; or
where any personal information has been processed on the basis of your consent or as necessary to perform a contract to which you are a party, request a copy of such personal information in a suitable format you can request this by emailing us at the address set out in the contact us section below. You will receive acknowledgement of your request and we will advise you of the timeframe within which you will receive your information in accordance with GDPR.

We endeavour to respond to such requests within a month or less as per GDPR regulations, although we reserve the right to extend this period for complex requests. We will update you if this is the case. You can at any time tell us not to send you marketing communications by email by clicking on the unsubscribe link within the marketing emails you receive from us or by opting out of text messages within the SMS you have received from us. Please note if you want to opt out of both email and SMS you will need to do so through those two channels. They are exclusive of each other. You can also contact us at the information below and state what you would like to be opted out of.

In any of the situations listed above, we may request that you prove your identity by providing us with a copy of a valid means of identification in order for us to comply with our security obligations and to prevent unauthorised disclosure of personal information.

We reserve the right to charge you a reasonable administrative fee for any manifestly unfounded or excessive requests concerning your access to your personal information, and for any additional copies of the personal information you request from us.

 

8) Activity on our digital platforms


Our websites may use social media features and widgets (such as “Like” buttons/widgets) These are provided and operated by third party companies (e.g. Facebook) and either hosted by a third party or hosted directly on our website or mobile application. These features may collect information such as the page you are visiting on our website/mobile application, your IP address, and may set cookies to enable the social media feature to function properly.

 

If you are logged into your account with the third-party company, then the third-party may be able to link information about your visit to and use of our website to your social media account with them. Similarly, your interactions with these features may be recorded by the third party. You can manage the sharing of information and opt out from targeted marketing via your privacy settings for the third party social media platform.

Your interactions with these social media Features are governed by the privacy policy of the third-party company providing them. IP addresses


When you access our website, or open electronic correspondence or communications from us, our servers and email broadcast provider may record data regarding your device and the network you are using to connect with us, including your IP address. An IP address is a series of numbers which identify your computer, and which are generally assigned when you access the internet.

 

We may use IP addresses for system administration, investigation of security issues and compiling anonymised data regarding usage of our website. We may also link IP addresses to other personal information we hold about you and use it for the purposes described above (e.g. to better tailor our marketing and advertising materials, provided you have opted in to receive electronic marketing).

Our Site may use “cookies” to enhance User experience. User’s web browser places cookies on their hard drive for record-keeping purposes and sometimes to track information about them. We will securely retain your data for as long as is reasonably necessary and in accordance with GDPR. The length we will hold your data for will depend on the programme you have booked with us. Please see the terms and conditions relating to the specific programme you have booked for more detail. 10) Changes to our Notice


We may amend this Notice from time to time. If we make a change to the Notice, the revised version will be posted on our website. It is your responsibility, and we encourage you, to check the website from time to time in order to determine whether there have been any changes. If we update our Notice, in certain circumstances, we may seek your consent.

Governing Law


8.1 These Terms and all disputes and issues between Funtasia and an Entrant arising out of or in any way relating to these Terms shall be governed by and construed in accordance with the laws of Ireland. Funtasia and Visitors hereby submit to the exclusive jurisdiction of the Irish Courts.

Waterpark


Children under the age of 8 must be accompanied in the water by an adult.Ratio Rule: 1:2 one adult may accompany up to two children under the age of 8; Children under 4 shall be accompanied on a 1:1 basis. Accompanying adults must not leave children under the age of 8 unattended or beyond eye contact. For health and safety reasons NO BUGGIES/PUSHCHAIRS are allowed in the Waterpark. For your convenience lockers are available in the Waterpark. A €1 coin is required which will be REFUNDED when you are finished using the locker. Due to the nature of the Waterpark, no food or drink is allowed into the Waterpark or the spectator’s area. Only bottled water. Remember the floors and walkways are very slippery. Please take care and no running allowed.
At times queues, can be long for the Waterpark generally between 12 pm – 3 pm. For your convenience, it is advised to consider doing another activity first and then go to the Waterpark at a quieter time.
Unfortunately, there is no re-admission into the Waterpark once you leave. People wishing to re-enter will be charged.
Please note pre-booked online tickets should be collected at the information desk. These tickets are discounted tickets only – normal queuing procedures apply
Anyone entering the Waterpark must pay the full admission price. Alternatively, there is a spectator area where you can view the Waterpark FREE of charge For customers wishing to assist with changing, it is possible to get a changing ticket from the Waterpark desk. You must give €12 deposit which will be refunded when you exit the Waterpark within the allowed time of 15 minutes. No cameras are allowed in the Waterpark or spectator area.
Swimming hats are NOT required
For health, safety and hygiene rules appropriate swimwear is required in the Waterpark, provocative attire, street clothes, clothing with buttons, belts or metal ornamentation are not permitted. T-shirts, shorts and wetsuits are permitted but you must shower before entering the pool. Swim nappies are required for all children not toilet trained.
You must bring your own towels, they are NOT provided. We do sell Towels at our Waterpark desk.
Changing tickets are available at the waterpark desk if guests require extra support in the changing rooms.
We operate a unique armband system for customers who would like an extra eye kept on them by staff during their visit. Please ask Waterpark reception desk for details.
WATER PARK SAFETY RULES
Read and obey all posted signs
Obey all instructions given by the attendants, operators and lifeguards.
No person should bring glass, cigarettes, gum or food into the water area.
Any person under the influence of alcohol or drugs will not be permitted in the Waterpark.
Pregnant women and persons with heart conditions or back trouble should not use slides.
No shoes to be worn past the shower area.
Loose Items, (glasses, cameras, wallets, hats, keys, etc.) should be left with non-riders or secured. We are not responsible for lost, stolen or damaged items. Eyeglasses must be securely affixed to riders with head straps. Ride at your own risk.
Customers are asked to shower before entering the pool.
Waterpark Caution
Look at the ride and decide if you can safely participate. You are the best judge of your limitations.
Shallow water. Customers must all enter feet first. Diving is not permitted.
Unruly behaviour and horseplay is not permitted.
Personal floatation devices, boogie boards and inflatable toys are not permitted. Please do not sit, stand or kneel on tubes.
Please follow instructions from lifeguards at all times.
Failure to follow these rules may result in injury to yourself or others.
Any person asked to leave for breaking rules will not be refunded any payments.
Water depth varies from 30cm to 150cm.
Height restrictions: o Frame slides: 1.07m
o Boomerang & Superbowl: 1.22m
Waterpark Accessibility And Special Requirements
Waterpark
Please speak to a member of our staff at the waterpark reception desk who will guide you through wheelchair access in the waterpark. Funtasia Waterpark provides numerous accommodations for guests with disabilities. Carers of special needs guests are FREE into the waterpark on the production oDisability/ Carers Membership Card e.g. Irish Autism Action or the Carers Association or GP Letter.
Accessible showers are located beside the locker rooms
Large family changing rooms are available beside the baby changing room Prices and general information Carers of special needs guests are FREE into the waterpark on the production of a disability/Carers Membership Card e.g. Irish Autism Action or the Carers Association or GP Letter.
10. Height Restrictions
Some activities (Sky Climb, Climbing Wall, Everest Free Fall, Zipline,
Boomerang, Super Bowl, Play Area) have height restrictions. These restrictions
are compulsory and access will be limited to people who meet the restrictions.
